How to Find Out Who Is Running the Defense’s Communications.

The public record usually shows it, if you know where to look. The press contact listed on a defendant’s release. The spokesperson quoted in coverage, and where that person worked before. A firm announcing a new client. A job posting for a litigation communications role. A court filing that names a consultant. Each name carries its source, and each is either confirmed by a document or indicated by the record.

Where to look, in order

Start with the defendant’s own newsroom and the wire services. A release about the litigation lists a media contact, and that contact is either in-house or at an outside firm. Then the coverage: a spokesperson quoted by name, whose prior affiliations are a matter of public record. Then the firms themselves, which announce major engagements. Then job postings, which describe the operation a defendant is building before it is visible anywhere else. Then the docket. Where none of those names anyone, say so, and describe the playbook in use instead of guessing at the firm behind it.

What to do with the names

A name is only useful with a record attached. Where has this firm, or these people, run a defendant’s communications before, and what did they do? The moves repeat: a pre-filing statement, an aberration defense, a rebuttal website, direct outreach to families, a standing team created for the litigation. Once the record shows the pattern, the next move is usually predictable to within a few weeks.

What it looks like done

I prepared a sample on the Flight 5342 litigation from public sources alone, with no firm retaining me. It names three in-house executives, with their prior roles, and notes that the sources reviewed do not name an outside firm. That is the honest shape of the answer: confirmed where the record confirms, and said plainly where it does not. The sample brief → What the full brief contains →
